This is the final Legislative Update.  Monday, May 28, 2007 was the last day of the 80th Legislative Session.  We are preparing a final Legislative Report that will be distributed to TCC and ACIT member companies.

TCC High Priority Bills: The following high priority bills passed during the last week of Session:

  • HB 3 (Puente, D-San Antonio), relating to the management of the water resources of the state, including the protection of instream flows and freshwater inflows.  The bill includes the Edwards Aquifer language by Senator Hegar (R-Katy) that TCC supported throughout session.  Specifically, Senator Hegar’s language eliminates the buy-down for downstream water right holders on the Guadalupe River and establishes downstream industry representation on the steering committee to review pumping from the Edwards Aquifer.

Week of May 14-18, 2007

High Priority Issue Update: On Friday, May 11, the House passed HB 3780 (Bonnen, R-Angleton), relating to initiation of enforcement by the TCEQ for violations based on information received from a private individual.  This bill addresses industry concerns related to TCEQ enforcement of self-reported violations (i.e., those reported under Title V).

    • SB 483 (Fraser, R-Marble Falls), relating to the regulation of electric generation capacity ownership in the electric power market.  TCC is monitoring this bill.

    • HB 1852 (Corte, R-San Antonio), relating to the authority of a county to regulate the installation and use of lighting in certain areas.

TCC High Priority Update
: HB 1526 by Chairman Wayne Smith (R-Baytown) passed the House on April 26.  TCC actively supports this pro-industry legislation and appreciates Chairman Smith for his efforts on this bill.
